MoEF orders closure of theme park

KOCHI: The Union Ministry of Environment and Forest (MoEF) has directed the Pappinissery Ecotourism Society to “stop all activities/ developments relating to the construction and operation of the mangrove theme park at Pappinissery panchayat.”

The order was issued in accordance with Section 5 of Environment (Protection) Act, 1986 and the Rule 4 of the Environment (Protection) Rules, 1986.

The order was issued as the “said area falls in Coastal Regulation Zone (1) and under the CRZ Notification 1991 such activities are not permissible”.

The society should withdraw the brochure titled “The Pappinissery Eco Tourism Society” immediately as the information contained in it was misleading. It should give wide publicity in the local newspapers regarding the withdrawal of the brochure.

Supreme Court orders

These directions were issued in accordance with the orders of the Supreme Court, said a communication issued by A. Senthil Vel, Additional Director of the Ministry.

The Kerala State Coastal Zone Management Authority (KSCZMA) and the Centre for Earth Science Studies, Thiruvananthapuram, should assess the damage inflicted by the society using time series satellite images and the details of destruction, including the cost involved for bringing back the original status may be worked out.

A report in this regard shall be submitted to the Ministry of Environment and Forests within three months.

It should take necessary action for restoration of the area and all cost for dismantling the existing infrastructure constructed in violation of the CRZ and restoration should be borne by the society.

An action plan in this regard should be submitted to the Ministry within two months, it was directed.

The KSCZMA should examine whether the society violated the Wildlife Protection Act and initiate action in case of violations.

It was earlier reported that the site of the park and the adjoining areas were habitats of several endangered species like turtles and birds listed in Schedule 1 of the Wildlife Protection Act.

It should ensure that the violation of the CRZ in and around the theme park was immediately stopped.

Steps to prevent dumping of city and town waste in the mangrove areas of the site should be initiated and an action plan prepared within three months, it was directed.

The State government shall inquire whether the society was operating the park in violation of the orders of the Supreme Court and take necessary action, the Ministry directed.
